By accessing and using Jobs To You (“Platform”), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and Jobs To You Limited, a company registered in New Zealand.

2. Use of Services

Our platform is designed to connect job seekers with potential employers. You agree to use our services only for lawful purposes and in accordance with these terms and all applicable New Zealand laws. You are responsible for:

• Maintaining the confidentiality of your account information
• Providing accurate and truthful information
• Complying with all applicable laws and regulations
• Respecting the rights of other users

3. User Content and Intellectual Property

You retain ownership of any content you submit to our platform, including profile information and resumes. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with our services. You represent and warrant that:

• You have the right to share all content you submit
• Your content does not infringe on any third-party intellectual property rights
• Your content is accurate and not misleading
• You have obtained all necessary consents and permissions

4. Prohibited Conduct

You agree not to use our services to:

• Post false, misleading, or fraudulent information
• Harass, threaten, or harm others
• Violate any laws or regulations
• Interfere with the proper functioning of our platform
• Engage in discriminatory or hateful conduct
• Attempt to gain unauthorized access to our systems
• Collect or use personal information of other users without consent
• Engage in any form of fraud or deception

5. Consumer Guarantees Act 1993

Under the Consumer Guarantees Act 1993, we guarantee that our services will be provided with due care and skill, and will be fit for purpose. However, this guarantee does not apply to:

• Services acquired for the purposes of a business
• Employment relationships or outcomes
• Third-party content or conduct

If you believe we have breached the Consumer Guarantees Act, please contact us immediately.

6. Disclaimer of Warranties

To the extent permitted by law, our services are provided “as is” without warranties of any kind. We do not guarantee:

• The accuracy, completeness, or reliability of any content on our platform
• That the platform will be uninterrupted or error-free
• The actions or conduct of other users
• The outcome of any employment relationships

We are not responsible for any loss or damage arising from your use of our platform or reliance on information provided by other users.

7. Limitation of Liability

To the maximum extent permitted by New Zealand law, Jobs To You shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Damages arising from third-party conduct or content

Our total liability to you shall not exceed the amount you have paid to us in the 12 months preceding the claim, or NZ$100, whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless Jobs To You, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our platform, your violation of these terms, or your infringement of any third-party rights.

9. Termination

We may terminate or suspend your account and access to our services at any time, with or without cause, and without notice. Reasons for termination may include:

• Violation of these terms
• Fraudulent or illegal activity
• Harassment or abuse of other users
• Inactivity for an extended period

Upon termination, your right to use the platform ceases immediately. We may retain your information as required by law.

10. Dispute Resolution

Any disputes arising from these terms or your use of our platform shall be governed by the laws of New Zealand and resolved through:

1. Good faith negotiation between the parties
2. Mediation through a neutral third party
3. Arbitration or court proceedings in New Zealand

You agree to submit to the exclusive jurisdiction of the courts of New Zealand.

11. Fair Trading Act 1986

We comply with the Fair Trading Act 1986 and do not engage in misleading or deceptive conduct. If you believe we have violated the Fair Trading Act, you may lodge a complaint with the Commerce Commission.

12. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the updated terms on this page and updating the effective date. Your continued use of our services after such modifications constitutes acceptance of the updated terms. If you do not agree to the changes, you must stop using our platform.
